California Man Killed After Illegal Alien Released Under Biden Policies Flees Police

SANTA ANA, CA - On Jan. 21, 2026, the blood on Joe Biden’s hands grew even larger when an illegal alien allowed to remain in the country on the Biden administration’s “catch and release” policies killed a 59-year-old man during a brief police chase, Fox News Digital reported. 

Darwin Felipe Bahamon Martinez, a 21-year-old illegal alien from Colombia, entered the United States near San Diego, CA, in 2023 and was released by the Biden administration, Immigration and Customs Enforcement said. 

“Bahamon Martinez illegally entered the U.S. near Chula Vista, California, in August 2023,” a statement from ICE Los Angeles said. 

“He was released into the U.S. under the Biden administration’s so-called ‘catch-and-release’ policies, but if that hadn’t happened, the innocent 59-year-old driver he allegedly killed may still be alive today.” 

Martinez was operating a Jeep Gladiator in Anaheim when police initiated a traffic stop for reckless driving. When officers approached the vehicle, Martinez sped away, authorities said. 

After a brief pursuit, Martinez crashed into two vehicles, including a Honda, killing the driver. He also struck a second vehicle, injuring an 83-year-old woman, who was taken to the hospital and treated for minor injuries. 

Martinez is currently being held in the Orange County Jail pending criminal proceedings. ICE lodged an immigration detainer against him on Jan. 22; however, because California is a sanctuary state, local authorities are not required to cooperate with ICE to transfer Martinez to federal custody. 

In a press release, ICE said:

“California must honor our immigration detainer. Otherwise, ICE will be forced to re-arrest this criminal illegal alien at large. At-large arrests are significantly more dangerous than custody transfers are because they require ICE officers to arrest unpredictable criminal illegal aliens in public settings.” 

That is precisely what Secretary of Homeland Security Kristi Noem has been trying to highlight, especially in light of violent anti-ICE protests that have been taking place in Democrat-run cities nationwide. Two of those violent protests resulted in the deaths of protesters who attacked ICE officers in Minneapolis.
