Biden judicial nominee sends male child rapist to female prison, says she is 'unqualified' to define what a woman is

WASHINGTON, DC - Back in August of 2022, United States Magistrate Judge Sarah Netburn, who was nominated for a seat on the United States District Court for the Southern District of New York by Joe Biden, ordered that the federal government house a biological male in a women's prison recently told Republican Sen. Lindsay Graham that she is "unqualified" to define what a woman is.

According to the Daily Caller, responded to written questions from Graham, who announced her response in a release by Republicans on the Senate Judiciary Committee. Graham, the Ranking Member of the Senate Judiciary Committee, said that Netburn claims she has "never studied" biology and therefore does not understand how sex is determined.

At her nomination hearing, Netburn was repeatedly questioned over the 2022 ruling to put a biological male, who was a convicted pedophile and child rapist, be "immediately transferred to a women's facility" over the many objections of the Bureau of Prisons (BOP).

According to the press release from the Senate Judiciary Committee, "The biological male in question was previously convicted and sentenced to decades in state prison for molesting a nine-year-old boy and raping a 17-year-old girl. Following the inmate's release in 2015, the inmate was again sentenced in 2017 to 15 years in federal prison for distributing child sexual abuse material."

Ranking Member Graham asked Netburn, "In your Report & Recommendation, you open your 'Factual Background' section by stating: 'At birth, people are typically assigned a gender.' ... Is it possible to determine a person's sex by only analyzing their chromosomes?" Netburn responded by saying, "I have never studied biology and therefore I am unqualified to answer this question."

Netburn's ruling in 2022 detailed the criminal history of the biological male who sued the BOP for the transfer to a women's prison. The ruling said, "Petitioner pleaded guilty in two Indiana state cases: to child molestation of a nine-year-old boy (a Class B felony) in the first case, and to rape of a 17-year-old girl (a Class B felony) and criminal deviate conduct (a Class B felony) in the second case. She was sentenced to two 18-year terms in state prison to run consecutively. She was released on parole after 18 years but violated the terms of her parole (for having internet access in her apartment) and was returned to prison for six years."

During a May 22nd confirmation hearing, Republican Sen. Ted Cruz questioned Netburn about the August 2022 ruling, during which he noted that the biological male's multiple convictions for sex-related offenses. Cruz said, "So you took a six-foot-two serial rapist, serial child rapist, with male genitalia, and he said, 'You know, I'd like to be in a women's prison,' and your answer was, 'That sounds great to me.'"

Cruz then asked, "Let me ask you something, the other women in that prison, do they have any rights?" According to the Daily Caller, President Biden's only nominee to the Supreme Court, Ketanji Brown Jackson, also similarly claimed to be unable to define what a woman is during her May 2022 confirmation hearings. 

During those hearings, Republican Sen. Marsha Blackburn of Tennessee asked Jackson, "Can you provide a definition of the word 'woman'?" Jackson responded by saying, "Can I provide a definition? No, I can't." When Blackburn asked why she was unable to provide a definition, Jackson said, "Not in this context. I am not a biologist."

Hopefully several of those real women in the prison will castrate this fake woman if he ever tries to hurt anyone. Cannot understand with his criminal history why he did not get the death sentence?

If you have male genitalia you are male. If you have female genitalia you are female. Any doubt and chromosomes will tell. A person can imagine they are something they are not but imagination doesn’t make it real.
