WASHINGTON, D.C. – A 12-year-old who is accused of taking part in a deadly carjacking has found himself in juvenile detention after his mother turned him in to the police to answer for his alleged crimes.
A mother had one of her worst fears realized when she saw video footage of a deadly carjacking which happened on October 28. The mother recognized one of the involved suspects in the carjacking, which left a 13-year-old dead, as her son. The mother made the gut wrenching decision to make her son face the music for his alleged participation in the carjacking and turned him in to police.
Police reports show the 12-year-old along with 13-year-old Vernard Toney, Jr., allegedly approached an off-duty U.S. Marshal who was sitting in his vehicle waiting to go into work for his shift. Toney and the other suspect, who has not been named, approached the marshal and demanded he get out of his vehicle.
Prosecutors in the case allegedly both boys put their hands in their waistbands which would have likely led the Marhsal to believe they had a weapon.
Toney then allegedly got into the passenger seat of the vehicle while the other suspect said, “Get the [expletive] out, you know what this is.”
Courtroom testimony showed the suspect saw the Marshal’s uniform and gun and ran to the passenger side of the vehicle to get Toney. However, prior to Toney exiting the vehicle, the Marshal apparently feared for his life and fired his weapon, striking Toney in the chest.
Both boys then fled the scene of the crime. However, Toney was unable to make it far and collapsed. Medics responded to the scene and took him to a nearby hospital where he succumbed to his injuries.
Police were unable to locate any firearms on or around the crime scene. They also did not locate any inside of his residence. The did, however, find the same clothes he was wearing at the time of the incident.
Courtroom testimony in the case showed the 12-year-old has a history of anger management dating as far back as him being five years old. Additionally, his mother testified that she has been trying to prevent the boy from getting in trouble, but he was known for disappearing for several days at a time. She also said she believed that he would know “where to get a gun.”
According to court records, this is the first time that the 12-year-old has had any interaction with the court system. However, based upon the circumstances, the judge in this case ordered the youth remanded into custody until his next court hearing.
While this incident is reportedly the first time the 12-year-old has been arrested, that is not the case for Toney. According to 4Washington, Toney was recently arrested in May for a series of armed carjackings. Toney was 12 at the time of those alleged crimes and the outcomes of those criminal cases are unknown.
