The sexual assault was carried out by a male student who “identified” as a female, with the attacks taking place in May and October, 2021, as reported in the Daily Mail.
The initial attack involved the skirt-wearing male student raping an underage girl in a high school restroom. Instead of expelling the student, Ziegler transferred him to another high school, where he attacked a second victim. The father in question, Scott Smith, was violently arrested at a Loudoun County school board meeting when he showed up to lambast the board for the apparent attempt to cover up the sexual assault of his daughter. The New York Post reported at the time that Smith and his wife Jessica were admonished by the school to keep quiet about the incident and became enraged when they found out the 15-year-old suspect was not expelled from school but rather transferred to the other high school, where he victimized another teenage girl.
“We were silenced for many months,” Jessica Smith told the Daily Mail. “We were told not to say a word that could jeopardize our daughter’s case.” In October 2021, the suspect was found guilty of the sexual attack on the Smith’s daughter. He also pleaded no contest to the second attack in an empty classroom at the Broad Run High School, where he touched a female student on her breasts and private parts. The Post wrote that the plea deal arranged with prosecutors had the suspect accepting the conviction on abduction and battery charges, but not admitting guilty, according to ABC-7.
“When I learned there was a second victim, I was dumbfounded,” Smith told the Daily Mail. “I didn’t believe it because I was under the impression that he was at home with an ankle monitor, not at school. We felt like this was our responsibility, what happened to this second victim,” Jessica Smith said as she became emotional. “The pain that we had on May 28 came back. All the hurt, the anger, the frustration, everything came back. I felt so horribly for the second victim and her family. This should have never happened. They shouldn’t have put him back in school.”
After Smith’s husband was arrested at a June 2021, school board meeting, critics soon asked for the resignations of Ziegler, as well as school board members. In fact, Ziegler initially lied about he attacks, denying any such incidents had happened in any school bathrooms in Loudoun County schools. He later apologized for lying. A report found the second sexual assault could have been prevented, however school administrators lied to parents in an attempt to cover up the controversy, which came about because of the district’s transgender bathroom policy. After the grand jury released its report, Ziegler was fired from his position as superintendent.
The grand jury determined Ziegler had engaged in a cover up of the rape of Smith’s daughter and the sexual assault of the second girl. Ironically, after the assault on their own daughter, the Smith’s actually asked for the suspect to receive rehabilitative treatment instead of jail time. However after the second incident became known, the Smiths became enraged and have now labeled the suspect as a “psychopath,” while warning “we are going to hear about him again.” Scott, however happy that he had received some vindication, was apoplectic after the grand jury failed to apply any criminal blame on the school, the teachers, and Ziegler, and instead only made recommendations on how to prevent such incidents from occurring again in the future.
In a statement to Fox News, Scott Smith said: “They just lie, lie, lie. I can show you the picture of what he looked like that day; it’s on my phone. “There was no kilt about it. I think he decided who he was and what he was on a daily basis. “I’ve seen evidence since that, unfortunately, my wife and I we fought very hard to get this child treatment and then evidence revealed to us after the fact that this kid’s a psychopath. “He’s a sexual predator, and unfortunately, we’re going to hear about him again,” Smith ranted.
It should be noted that the school board didn’t escape totally untouched. The grand jury blamed the school board for being only concerned about themselves, not the student victims. It is widely believed that the actions (or more specifically inactions) of the Loudoun County School Board is what led to the election of Republican Gov. Glenn Youngkin. One cannot assume that these two incidents are isolated, when you have testosterone-laden teenage boys pretending to be girls so they can get their raging hormones into the girls’ bathrooms. This likely wasn’t the first time such an incident happened and it will not be the last, as long as we allow boys to play pretend so they can enter female bathrooms and locker rooms.
