WASHINGTON, DC - Former U.S. Attorney for the District of Columbia turned NBC/MSNBC legal analyst Glenn Kirschner posted a video to his YouTube channel making the recommendation that incumbent Democrat President Joe Biden, operating under a flawed analysis of the Supreme Court Ruling in Trump v. United States on Presidential immunity, should forcibly prevent the former President's re-election.
As reported by The Daily Caller News Foundation, the former Federal Prosecutor suggested that the ruling - which specified that presidents are protected by immunity from criminal prosecution for “official acts" - somehow conveys the ability for Biden to “use his attorney general to jail his political rival and all other perceived enemies.”
He explained, "This is going to sound like the stuff of Hollywood scripts, but it’s a conversation we need to have. President Biden can use his new power, power that the Supreme Court just bestowed on him.
"Unfortunately, it is the power of lawlessness, lawlessness with impunity and immunity. He can use that power to protect American democracy against an avowed day-one dictator. Hard to imagine we’re having that conversation, but just imagine, friends, if Donald Trump retakes the reins of governmental power and he becomes the dictator he has promised us he will become.”
He continued, claiming: "A president through his attorney general can jail those folk without charges, without evidence, without any due process and there’s not a damn thing law enforcement, prosecutors or the courts can do about it."
However, the ruling states clearly that "as for a President’s unofficial acts, there is no immunity." The type of action Kirschner describes falls clearly outside of any rational reading of the court's opinion and any reasonable interpretation of what constitutes an "official act."
Chief Justice John Roberts writing for the majority found, "The President therefore may not be prosecuted for exercising his core constitutional powers, and he is entitled, at a minimum, to a presumptive immunity from prosecution for all his official acts. That immunity applies equally to all occupants of the Oval Office, regardless of politics, policy, or party."
In the framework of the Supreme Court's ruling, not even the most generous reading of a president's "core constitutional powers" could justify Kirschner's proposal.
However, in the unlikely event that it could, it could arguably end in the impeachment of said president and subsequent prosecution for the deposed Chief Executive in question, as such actions could rise to "high crimes and misdemeanors" as called for in Article II Section 4 of the Constitution.
