Illegal immigrant arrested for murder after several arrests; county has denied all ICE detainers for him

FAIRFAX COUNTY, VA - One of two suspects in custody connected to a murder in Oakton, Virginia was revealed by immigration officials to be an illegal immigrant from Honduras with a history of arrests for violent crimes, according to multiple reports.

The Enforcement and Removal Operations (ERO) division of ICE reportedly placed repeated immigration detainers on Guzman-Videz with the Fairfax County Adult Detention Center, however, the County refused to honor them.

Maudin Anibal Guzman-Videz was placed under arrest last weekend, but the Fairfax County Police Department has said it is not the first time he's been in custody. Guzman-Videz was reportedly arrested for malicious assault for severely injuring a victim, along with other charges on March 17th. As reported by WJLA, he was arrested yet again in June and charged with malicious wounding. 

According to Fox5DC, Guzman-Videz entered the United States illegally in November 2018 near Hidalgo, TX, and was apprehended by the U.S. Border Patrol. After being detained by Border Patrol, he was released with a notice to appear before an immigration court.

In July 2019 his deportation was ordered by a Houston immigration judge. However, Guzman-Videz remained at large in the U.S.
 
Since 2019, Guzman-Videz's encounters with the law for violent crime escalated until his arrest in connection to the murder of an unnamed 20 to 30-year-old Hispanic male found with blunt force trauma and stab wounds near a popular walking trail.

In a Fairfax County policy statement on "undocumented inmates" issued Thursday, Fairfax County Sheriff Stacey Kincaid wrote, "Our policy clearly states that the Sheriff’s Office will detain any individual who has a judicial warrant authorizing their arrest, including a judicial immigration warrant. The Fairfax County Sheriff’s Office will not detain an individual based on an informal request or detainer."

The statement justified this position by citing an Advisory opinion issued by the Virginia Attorney General Mark Herring that said, "[A]n ICE detainer is merely a request. It does not create for a law enforcement agency either an obligation or legal authority to maintain custody of a prisoner who is otherwise eligible for immediate release from local or state custody."

WJLA reported that per the Fairfax County Sheriff’s Office 725 "undocumented individuals” have been incarcerated at the Fairfax County Adult Detention Center in the last year. Their alleged offenses range from violent crimes to child sex crimes however, the Sheriff's Office refuses to honor any administrative ICE immigration detainers, requiring a judge's order to do so.

The Fairfax Sheriff has only transferred three of the 725 illegal immigrants back to ICE, the others were reportedly released back into Fairfax County.

Didn't they sign on to serve/protect? Any sheriff that refuses to do their duty should not be a sheriff or part of any law enforcement agency - PERIOD. The/any sheriff that refused to honor the detainer should not only lose their job (not allowed to retire) but any/all pension since they failed to do their job.

Fairfax County, Va. as well as Loudon County, Va. not places you WANT to live if you VALUE family and safety. They have GONE woke and VERY left of center. Extremely HIGH property taxes with NO positive end results. Socialist County of Va.

Our local Sheriff said they don't bother citing illegal immigrants for even grave traffic violations, because they know they won't show up for court, and it will only be a burden on the court system and local taxpayers, to no avail. Their immigration hearings are 6 years out! He (local sheriff) and other sheriffs around the nation went to directly address Mayorkas, about this problem, and Mayorkas didn't give a D@#&.
