STERLING, VA - Jose Aguilar-Martinez, 21, an illegal immigrant from El Salvador allegedly stole the vehicle of 54-year-old Melody Waldecker and fatally ran her over at a 7-Eleven convenience store in Virginia. Reports Thursday confirmed that Aguilar-Martinez was issued a driver's license by California, one of the 16 states that allow illegal immigrants to obtain a license.
As reported by Newsweek, Waldecker was struck by Aguilar-Martinez with her own car on July 28 as she exited the 7-Eleven and the suspect sped away. She was pronounced dead at the scene. Loudoun County Sheriff Mike Chapman said in a press release, "This is a horrific tragedy, and we mourn the death of Melody Waldecker as the result of the heinous actions by a suspect in our nation illegally."
Speaking to ABC7, Chapman revealed that Waldecker, a resident of Maryland, was in Virginia to visit her mother at a rehabilitation nursing facility in Loudoun. He told the outlet, "[She] came out to help her out and the next thing you know she comes out of the 7-Eleven and that's the end of her life. Tragic. Should've never happened."
The Sheriff explained that Aguilar-Martinez was reportedly living in Sterling at the time and held a California Driver's License that listed an address in Los Angeles. He told reporters, "The fact that he had a California driver's license is perplexing to me."
According to the outlet, The Loudoun County Commonwealth’s Attorney’s office told 7News that Aguilar-Martinez was arrested and they plan to charge him with homicide for the murder of Waldecker.
Sheriff Chapman described the attack to reporters, saying, “Running her right over, complete disregard for her life, complete disregard for anybody in the area. [He] took off, ends up getting into two car accidents while he’s fleeing away. He is here illegally. And that’s why this could have been prevented. Had he not been in this country illegally, this would have never happened and that’s the problem.”
Immigration and Customs Enforcement has reportedly issued a detainer against Aguilar-Martinez. Aguilar-Martinez was also arrested in Loudoun County in July for public intoxication. Chapman said he contacted ICE for a detainer, however, the suspect's illegal status couldn't be confirmed.
“No, they didn't. That’s a civil fine, a drunk in public,” Chapman said. “I think they just hold you overnight until you sober up and your let go because it’s a civil fine. They couldn’t confirm that he was illegal. At the time, they couldn't confirm that he was a violent criminal.”
