DORCHESTER, MA— Pierre Lucard Emile, 31, after being arrested and charged with the rape of a developmentally disabled person, was released from a Boston jail in direct defiance of a detainer issued by US Immigration and Customs Enforcement (ICE). He is now back in federal custody.
As reported by Fox News, ICE said in a statement, "Disturbingly and despite our filing an immigration detainer, this individual was released back into the community by the criminal court."
Emile reportedly arrived at the U.S.-Mexico border at Brownsville, TX back in December of 2022 and was subsequently released into the U.S. under the Biden Administration's policies with a notice to appear before an immigration court after being deemed inadmissible to the country.
Bill Melugin reporting for the outlet to X wrote that after the "sanctuary" jurisdiction of Dorchester, MA refused to honor the detainer from ICE, federal authorities in Boston recaptured and arrested Emile. He is now being held pending trial for the rape charges and will face deportation after his case is adjudicated and any sentence imposed by the Massachusetts court is served.
Enforcement and Removal Operations (ERO) Boston Field Office Director Todd M. Lyons explained,
"The men and women of ERO Boston continue to protect the community from those who pose a real public safety threat to our communities. We remain strongly committed to protecting residents in communities by apprehending those who are not lawfully present in this country and pose a threat to public safety. This remains central piece of our mission.”
According to the release, the ERO division of ICE arrested 73,822 illegal aliens in 2023 with a criminal history. Among those arrested, there were an average of four charges and convictions per individual. This included "more than 33,209 charges or convictions for assault, 7,520 for weapons offenses, 1,713 for homicide-related offenses, and 1,615 for kidnapping."

“In September 2023, Boston police arrested him for rape and indecent assault and battery on a developmentally disabled person,” ICE documents stated. Emile was rearrested on Jan. 9th, after being loosed on the streets of Boston by the Dorchester District Court for almost three months.
In a press release, ICE stated “After becoming aware of his recent arrest and unlawful immigration status, ERO Boston began an investigation to confirm the Haitian citizen’s presence [in] its area of responsibility. Congrats to ERO for doing their job. Shame on the United States for allowing an inadmissable person to to be allowed to enter the United States and shame on Dorchester MA sanctuary jurisdiction for their stand. Most of all shame on the legal system for ignoring the Ice detainer on this person. Thus , this illegal immigrant is released by our legal system. Obviously the police and courts in Boston are not doing their jobs. They should be schooled on what a detainer is and protect the victims. We have enough crime without legal immigrants committing heinous acts against US citizens and therefore citizens are not being protected. What is the matter with this country and why do our representatives, senate, legislature and Congress do something about it. Shame on Biden and our laws in the United States of America
