BALTIMORE, MD - The Fells Point elderly man who was walking his dog in the middle of the day on Saturday, August 17th, and was violently attacked in what appears an unprovoked incident, has died.
According to CBS News, the victim, 74-year-old David Philpot was approached by a man who asked him for money, and when Philpot said he didn't have any, video surveillance of the incident shows that he was pushed to the ground and then violently kicked. The suspect, since identified as 43-year-old Timothy Clinedinst, has been arrested and charged with involuntary manslaughter.
Philpot's wife, Mary Margaret Philpot, confirmed that her husband succumbed to the injuries sustained in the attack. She said, "He said, 'This guy asked me for money,' and he told him, 'I don't have any money.'" Philpot died a day after being taken to the hospital. Mary said, "He shouldn't be dead. He wouldn't be dead if it weren't for this person."
The wife said that the attack of her husband aggravated a pre-existing heart condition. She said, "It's so hard to imagine that anybody would do anything like that." Both Philpot and his wife are well-known around their community of Fells Point. They retired there together nearly a decade ago. Friends of the duo at a nearby business said that they are heartbroken.
E.C. Pops owner Doug Yakey said, "Dave was just an incredible soul. He was very much like a fatherly figure, not with just me, but everyone he came in contact with." According to WBALTV, the medical examiner's office ruled Philpot's death a homicide. Clinedinst was booked on the involuntary manslaughter charge.
A family friend, Lynda Sebastianelli said, "Why would someone be that cruel? And an older man with his dog?" Others in the community described Philpot as a friendly, caring person who also did volunteer work. Sebastianelli said, "It's unbelievable. A kind of sould, like, we all loved him. He was gentle, sweet. He walked his dog every day right past our house on the other side of the street. And how anyone could do this to him? Asking for money, and he didn't have any."
Philpot's neighbor, David Chebahtah said, "This, whoever it is, destroyed a community, really, because everybody around here knows Dave and knows what a sweet man he was."
Sebastianelli said, "For someone to do that over what, a quarter or a dollar or something? And be so angry that you would shove someone in the street. And an older man, who was the kindest man, I think, of anybody down here." A GofundMe page has been setup to help Philpot's family cover funeral costs.

Why wasn't Clinedinst charged with murder ? Mr. Philpot died as a result of a beating by Clinedinst ! That sounds like murder to me.
