Are we headed for a showdown between the State of Texas and the federal government at the southern border? It sure seems that way. Gov. Greg Abbott, utilizing the Biden playbook of ignoring Supreme Court rulings, is doubling down on his vow to protect his state from a foreign invasion.
In case you missed it, Abbott directed public safety assets under his control to erect razor wire in the Rio Grande. He permitted private landowners to do the same thing on their property that abuts the US-Mexico border. Since Biden has ignored one of his primary responsibilities–to protect and defend the United States from foreign invasion–Gov. Abbott found it necessary to protect the citizens of his state.
Last week, the Supreme Court ruled 5-4–with “conservative” justices John Roberts and Amy Coney-Barrett joining the radical leftists on the high court–in ruling against Texas in their fight to protect themselves from the unprecedented invasion at the southern border. With nowhere else to turn, Abbott followed Biden’s lead by simply ignoring the high court.
Abbott has received almost unanimous support from other Republican governors while, as expected, Democrats seem to have no problem with the humanitarian and trafficking crisis at the border. What the Supreme Court has done is set up what will possibly be a constitutional crisis. Those supporting Abbott include Florida Gov. Ron DeSantis, South Dakota Gov. Kristi Noem, Virginia Gov. Glenn Youngkin, and Georgia Gov. Brian Kemp.
Many constitutional scholars believe that Abbott is standing on solid legal ground, as did DeSantis.
‘If the Constitution really made states powerless to defend themselves against an invasion, it wouldn’t have been ratified in the first place, and Texas would have never joined the union when it did,” DeSantis said on X. “TX is upholding the law while Biden is flouting it.”
Youngkin said that the Biden administration “has turned every state into a border state” and claimed Abbott is doing what Biden, DHS Secretary Alejandro Mayorkas, and other border officials “refuse to do to secure our border.”
Meanwhile, several Democrats have called on the feeble, cognitively impaired BIden to nationalize the Texas National Guard, setting the stage for a conflict between the State of Texas and the federal government.
Under Article 1, Section 10, Clause 3, Acts Requiring Consent of Congress, it reads, with pertinent points highlighted:
No State shall, without the Consent of Congress, lay any Duty of Tonnage, keep Troops, or Ships of War in time of Peace, enter into any Agreement or Compact with another State, or with a foreign Power, or engage in war, unless actually invaded, or in such imminent Danger as will not admit of delay.
It appears Texas can easily make a case that it is being invaded with no help from the federal government.
Article II, Sec. 3 is the “Take Care” clause of the Constitution. Under that section where the duties of the president are defined, it says, in part:
…he [the president] shall take Care that the Laws be faithfully executed, and shall Commission all the Officers of the United States. [emphasis added]
Under the annotations of that section, it says explicitly:
(4) power that stems implicitly from the duty to enforce the criminal statutes of the United States… [emphasis added]
Article IV, Sec. 4 of the Constitution reads:
The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against invasion… [emphasis added]
Black’s Law Dictionary defines invasion as An encroachment upon the rights of another…
It is easy to prove that the rights of Texas citizens…life, liberty, and the pursuit of happiness…are being infringed upon by the foreign invaders at the southern border. Perhaps the most amusing thing to see is to watch Democrats going apoplectic over Abbott’s pledge to defy the Supreme Court.
Let’s take the way back machine to last year when two Democrat-run states–New York and California–openly defied the Supreme Court’s rulings over gun control. Both states passed radical legislation AFTER the Supreme Court ruled against draconian gun control laws in each state in complete defiance of the high court.
In California, for example, the legislature passed a law–backed by Gov. Gavin Newsom–that in some ways made it easier to obtain a carry permit but made it nearly impossible to use by restricting gun possession with a permit from almost all property outside the home in the state. New York did the same thing.
So, for Democrats to lose their minds over Gov. Abbott defying the Supreme Court to protect the citizens of his state is laughable.
Then there are the times that old Dementia Joe defied the Supreme Court, like when he unilaterally implemented an eviction moratorium during the plandemic, er pandemic.
Biden also ignored the Supreme Court’s ruling blocking Biden’s student loan forgiveness debacle. As he did with the eviction moratorium, he simply ignored it.
As mentioned above, we are headed for a constitutional crisis the likes which hasn’t been seen since before the Civil War. Probably the juiciest thing that could come out of this is the visual of Biden using federal law enforcement to forcibly allow illegals into the country, thereby breaking our immigration laws in the process.
Think about this for a minute. Gov. Abbott instructed his law enforcement and National Guard to erect razor wire to protect his citizens from an alien invasion. The Biden administration went to court to prevent Abbott from protecting his citizens from an alien invasion. Exactly whose side is the Biden administration on? That’s a rhetorical question–we all know whose side they are on.
Many Americans have pledged to help Texas at the border, seeing that the Lone Star State is overwhelmed. As Law Enforcement Today recently reported, leftist Democrats in Congress have introduced a bill, HR-6981, the so-called “Preventing Private Paramilitary Act of 2024.” It is the “brainchild” of Rep. Jamie Raskin (D-Maryland), he of the so-called “select committee” that investigated the Jan. 6 siege at the US Capitol.
What does that bill have to do with the border? It would effectively criminalize (not that Democrats typically worry about actual crime) so-called “unauthorized paramilitary activity.”
How is that defined?
§2742. Unauthorized private paramilitary activity
This law would circumvent the Second Amendment’s clause of a “well-regulated militia.” The only exception under the proposal defines an exception as any regularly organized State militia, or any unorganized or reserve militia called into service by a State or the United States.
The last part of that clause could actually prove a saving grace for patriots who would wish to assist in a state like Texas since any such militia could be “called into service by a State…”
What is a “private paramilitary organization” as proposed in the bill?
PRIVATE PARAMILITARY ORGANIZATION–The term “private paramilitary organization” means any group of 3 or more persons associating under a command structure for the purpose of functioning in public or training to function in public as a combat, combat support, law enforcement, or security services unit.
Also, fear not. Raskin makes sure that the government will be able to get full control of any weapons or equipment used in violation of the law:
(e) FORFEITURE–
- IN GENERAL–Any person who violates subsection (a) shall forfeit to the United States any property, personal or real, involved in, used, or intended to be used, in any manner or part, to commit, or to facilitate the commission of, the violation, or that constitutes or is derived from proceeds traceable to the violation.
Many conservatives, including Dan Bongino, Glenn Beck, and Tucker Carlson, believe the United States is headed for some bad times. Ground zero may indeed be in Texas.

Biden can't outlaw Militias because they are specifically authorized in the constitution. He may try but it can't hold up. If the SCOTUS rules against the constitution there will be a backlash such as this nation has not seen since the civil war! Can Abbott deputize the militias? References to the Civil War here in the post and the comments are well-founded. Part of the argument during the Civil War was about states' rights. The South lost that war but its constituent states did not lose their states' rights. This means that each state holds a kind of autonomy, and the federal government has no right to enter the state unless invited. When Hurricane Katrina struck New Orleans in 2005, President Bush was excoriated roundly (by the ignorant) for not sending in FEMA and other federal support agencies before or as soon as possible after. He did not do so because of states' rights. He consulted with the Louisiana governor on a daily basis for nearly two weeks in advance of the storm, which was one of the most broadly followed in history (it wandered around the Atlantic for nearly three weeks before it decided to move). Every day, the governor waffled and said, "I'm going to wait to see what it does." Only after the hurricane struck, only after the damage was done did the governor give the federal government permission to send help. A short time later, Jeb Bush, governor of Florida at the time, got on the horn with his brother, the president, long before a later hurricane struck and arranged for federal services in advance. He gave the federal government permission to come in, and so they did, helping the population prepare for landfall. What happened at New Orleans did not happen in Florida. It's states' rights, folks. Texas has a right to defend its borders, whether or not its borders are shared with a foreign nation. Utah and Kentucky have those same rights, and there's nothing the federal government can do about it. It's the law. Texas is indeed being invaded and they have every tight under their Constitution to defend themselves and even under the US Constitution they have the right to defend themselves from illegal immigration. I do not believe that this will end up as a Civil War as the Law is on the side of Texas in this case. Even those immigrants who have come here legally do not want these Illegals to come in here and possibly take their jobs. What is needed is to seal the Boarder as best we can to protect us from terrorists and those who wish us harm, either physically OR financially. We ARE NOT going to give these illegals Citizenship, period. At most they will have to leave and then re-enter the US in the proper manner and apply in the legal manner.
