Gill who sits on the House DOGE Committee as well as the House Committee on Oversight and Government Reform said in a post to X announcing the bill “The CCP’s Marxist infiltration threatens our farmers, food, security, and sovereignty—they have NO place on our soil.”
The bill as reported by Breitbart News will apply the same level of restrictive regulation which prohibits American citizens and firms from purchasing land in the adversarial nations, particularly China.
Gill said in a statement to Breitbart,
“If a foreign country prohibits Americans from purchasing land in their country, we should do the same to them. The Chinese Communist Party is one of the biggest offenders. The CCP has no place on our nation’s soil. My Land and National Defense Act is a commonsense solution to keep our adversaries from owning our farmland.”
According to China Legal Experts based in Nanshan in the Shenzhen province, foreign nationals in China are not permitted to buy land. However, with a valid residence, they are permitted to lease one residential property for their personal use or rental only with a time limit of 70 years, after which the land and home revert to government ownership.

Commercial buyers face a far more complex process in which they must acquire a Chinese business license. Agricultural land in particular holds serious restrictions. Foreigners may not under any circumstances buy agricultural land, and may merely lease and use it for up to a maximum of 30 years or invest in Chinese rural collectives.
As noted by the outlet, the U.S. Department of Agriculture (USDA) reported that foreign nationals and entities hold an ownership stake in 45.85 million acres of agricultural land in the United States and the U.S. legal code does not presently impose any restrictions upon this despite the hostility or adversarial state of the nation concerned. This is particularly impactful when regarding communist and authoritarian countries like China where foreign governments operate all businesses as effectively state-owned.
In a press release dated July 2023 from Rep. Mike Collins (R-GA) noted, “China owns 384,000 acres of American agricultural land. That's a 30% increase just since 2019. And on top of that, they own land near an Air Force base in North Dakota. That's a clear threat to our national security.”
Speaking with Breitbart News Washington Bureau Chief Matthew Boyle USDA Secretary Brooke Rollins said that a “federal solution” to ceasing Chinese nationals and entities’ land purchases is being explored.
“With my experience in the states, I am a huge, huge believer in the laboratories of democracy—the 10th Amendment says our states are the guardians at the gate—and for the last several years my organization America First Policy Institute, we actually worked among multiple states to get states to act on this to pass state legislation but we also are looking at a federal solution too,” Rollins said.
The proposed bill is supported by Reps. Doug LaMalfa (R-TX), Josh Brecheen (R-OK), Clay Higgins (R-LA), Marlin Stutzman (R-IN), and Marjorie Taylor-Greene (R-GA) according to Gill. The congressman also thanked The Bull Moose Project and Texas Agricultural Commissioner Sid Miller for supporting the measure.
