In a blow to Joe Biden and "Border Czar" Kamala Harris, Missouri Attorney General Andrew Bailey obtained a court order forcing the Administration to spend congressionally appropriated dollars to construct a barrier along the southern border.
In a post on X, AG Bailey wrote, “I obtained a court order forcing border czar [Kamala Harris] and [Joe Biden] to finish President Trump’s border wall."
AG Bailey stated, “The Biden Administration has failed to abide by the law to finish the construction of a long along the Southwest Border. Joe Biden refuses to carry out his constitutionally mandated responsibilities, so we took him to court to force him to do his job.”
In 2020, Congress passed a law requiring the president to construct barrier systems at the southern border to keep unauthorized individuals out of the country. The law provided $1.4 billion and states the money may only be used for constructing barrier systems along the southwest border.
The Biden-Harris administration was asked why the money was not spent on the border wall according to the law passed by Congress, to which it replied, "[W]e do not agree with the building of a wall."
There have been record-breaking migrant crossings and record numbers of illegal immigrants coming into the United States. With this has come an increase in illegal drugs, crime, and a strain on governmental resources.
The Biden Administration attempted to argue that AG Bailey did not have standing to challenge the refusal to use the funds. However, the Fifth Circuit Court of Appeals ruled that states can bring a challenge. Alongside Missouri, Texas has filed a similar lawsuit.
“Walls and fences have existed at the border between the United States and Mexico for years," the ruling pointed out.
At this time, it appears that the Biden-Harris Administration will not be appealing the ruling. AG Bailey said that fact makes "our win FINAL.” He also said, “The rest of President Trump’s border wall is going up because of this lawsuit."

Attorney General Bailey is the 44th Attorney General and was sworn into that office in 2023. He served in the Army and also served as a prosecutor. More about him can be found on his website.

The Biden/Harris duo sold much of the material to build the border wall for scrap metal and they should be FORCED to replace that material at their own personal expense!
