PENSACOLA, FL - Under the transparency ordered by the U.S. District Court for the Northern District of Florida Judge T. Kent Wetherell II, Immigration and Customs Enforcement (ICE) has been forced to reveal that of 2,572 illegal immigrants released through a "special" parole program, 99.5% are still at large.
As reported by The Washington Times, Judge Wetherell ordered ICE to report to him on the 2,572 illegal immigrants after the Biden administration released them in defiance of his court order halting the parole program. The Department of Homeland Security reportedly released the foreign nationals without a pending immigration court date.
Rather, the ICE officials told the detainees that they would need to check in with immigration within a sixty-day window. Over 40% of the illegal immigrants violated the check-in period, and a larger segment still hasn't been served a Notice-To-Appear.
Wrangling with The 11th Circuit Court of Appeals over whether his court has “jurisdiction” over a Florida challenge to Biden's immigration policies, Wetherell wrote, "The policies at issue in these (Florida) cases do not involve arrest or prosecution, but rather explain how DHS (the U.S. Department of Homeland Security) will exercise its statutory ‘parole’ authority … with respect to aliens who are already in DHS custody after arriving at the southwest border.”
He added, “Nothing in Texas (the U.S. Supreme Court opinion) held that federal courts cannot adjudicate the validity of non-detention/parole policies like these.” according to The South Florida Sun Sentinel.
On March 28th, Wetherell extended a stay on the case between Florida and Homeland Security Secretary Alejandro Mayorkas ordering that "The parties shall file a status report 7 days after the Eleventh Circuit issues its decision (and every 60 days until then) indicating whether the stay should remain in effect, and if not, how the parties intend to proceed with this case."
Pressured by the Judge, ICE pressed to secure more check-ins to serve more NTAs and new summonses, however, few have responded. Over 300 illegal immigrants are currently in the open without an NTA, and one has filed an asylum application.
