AUSTIN, TX - The Texas Department of Public Safety (DPS) has arrested another illegal immigrant from Texas' "Most Wanted List" in Round Rock. The illegal immigrant is from Mexico and was wanted out of Travis County for violent offenses.
Identified as 25-year-old Fabian Martinez Toribio, the criminal illegal immigrant had a warrant for arrest on charges of aggravated sexual assault of a child and possession of a controlled substance. He was taken into custody on Wednesday, August 7th, by DPS Special Agents and the U.S. Marshals Lone Star Fugitive Task Force. He has been booked into the Williamson County Jail.
The arrest of the illegal immigrant was a result of investigative efforts and a series of leads by DPS Special Agents assigned to the case. According to DPS, Martinez Toribio was arrested and convicted of entry without inspection in April 2018 and was subsequently removed from the United States. A few years later, in October of 2023, he was arrested by the Manor Police Department (MPD) for resisting arrest/search and possession of a controlled substance.
He bonded out of jail and then in January of 2024, the Austin Police Department (APD) issued a warrant for his arrest for aggravated sexual assault of a child. A month later, in February a warrant was issued out of Travis County for his arrest for possession of a controlled substance. According to reports, Martinez Toribio was the third arrest since the list was launched in June.
The "Most Wanted" criminal illegal immigrant list was launched to raise awareness about and help law enforcement find repeat offenders who are in the United States illegally and are wanted for allegedly committing dangerous crimes in the state of Texas. All of the individuals on the list are Hispanic men with the majority of them being citizens of Mexico. The others on the list are from El Salvador and Honduras.
The illegal immigrants are wanted for a range of violent crimes, including sexual assault of a child, indecency with a child, aggravated sexual assault of a child, smuggling of person, terroristic threat, aggravated robbery, injury to a child, elderly disabled, among others.
Within less than 24 hours of first launching the "Most Wanted" list, one Mexican national wanted for homicide was arrested in Baytown. A week after that, another Mexican national was arrested in Fort Worth. That individual had been reportedly convicted in Tarrant County of driving while intoxicated with a child under the age of 15, assault causing bodily injury to a family member, assault, failure to identify/giving false/fictitious information, and failing to identify as a fugitive.
After the arrest of Martinez Toribio, newly elected state representative who represents the area, Rep. Caroline Harris Davila said in a statement, "What happens at the border doesn't stay at the border. This criminal was roaming free in our community, in my hometown. We cannot afford to have a president who will not secure the border."
The list states where the fugitives were last seen in Texas, with the number one most wanted, Luis Perez Mendoza's last known address of Conroe, a suburb located an hour north of Houston. Other last known addresses of these criminals include rural suburbs and major cities in Texas, including Pflugerville, Irving, Dripping Springs, Austin, Cleveland, Houston, Marshall, and El Paso.
Through Governor Greg Abbott's border security mission, Operation Lone Star, law enforcement officers have apprehended more than 517,000 illegal immigrants and made more than 45,700 criminal arrests, with more than 36,900 felony charges. They have also seized more than 506 million lethal doses of fentanyl, which is enough to kill the combined populations of the United States and Mexico.
