CHICAGO, IL— Juan David Ramirez-Olivo, a 19-year-old illegal immigrant arrested last week in Chicago and described as "dangerous," will not be prosecuted by order of Cook County State’s Attorney Kim Foxx, according to reports released Thursday.
As reported by Fox News, Foxx’s office claimed in a statement, "After a thorough review of information presented to us by police, we concluded that the totality of the evidence was insufficient to meet our burden of proof to file criminal charges."
"As prosecutors, we have both an ethical and legal obligation to make charging decisions based on the law and evidence. We are open to a further review if new or additional information is brought to us."
A source within CPD told Fox News that a police chief working the case strongly disagreed with Foxx's decision. "If they want to say that it was a complete accident and it wasn’t reckless then minimally charge him with the weapon that he admitted to illegally purchasing," the source told reporters. "No one thinks it’s legal to purchase a gun off a guy on the street. Plus, he shouldn’t even have a weapon."
As previously reported by Law Enforcement Today, Ramirez-Olivo was arrested in connection with the death of Stephanie Lopez Ramirez, 17, who was found dead by Chicago Police from two gunshots in an apartment the two were previously in together. The police also told reporters that Ramirez-Olivo was illegally in possession of a firearm at the time of the murder and allegedly purchased the weapon on the street.
Fox News reported that according to Police records the suspect was arrested previously in March for possession of a knife. He was also arrested previously in connection with a stabbing.
According to early reports an ICE spokesperson, Erin Bultje, told Fox News, "On Oct. 3, officers from U.S. Immigration and Customs Enforcement’s Enforcement and Removal Operations Chicago lodged an immigration detainer with Chicago Police Department’s 11th District on Juan David Ramirez-Olivo, 19, a Colombian national, following his arrest for murder in the first degree."
It is unknown as of this report if Ramirez-Olivo is still in custody with Cook County following the State's Attorney's decision not to prosecute
