Democrats led by Rep. Jaime Raskin threaten 14th Amendment move to disqualify Trump from presidency

WASHINGTON, D.C. - Democrat Congressman Jaime Raskin (D-MD) generated serious concern on August 5th when he said in a now-viral video that Democrats in Congress must disqualify President Donald Trump from holding the presidency and block the certification of his election under Section 3 of the 14th Amendment to the Constitution by enacting "civil war conditions."

As reported by The Daily Wire, Raskin citing the US Supreme Court ruling in Trump v. Anderson the Congressman said that the judges "want to kick it to Congress, so it’s going to be up to us on January 6, 2025, to tell the rampaging Trump mobs that he’s disqualified."

Startling many, Raskin added, “And then we need bodyguards for everybody, and civil war conditions, all because the nine justices — not all of them, but these justices who have not many cases to look at every year, not that much work to do, a huge staff, great protection — simply do not want to do their job and interpret what the great 14th Amendment means.”

Republican former Republican Congressman Lee Zeldin (R-NY) shared footage of the moment and expressed alarm on X writing, "Even if voters unquestionably elect Donald Trump as President, no matter the margin, and even if the election is universally accepted as free and fair, top Democrats are calling on Congress to block certification of the results, and prep for civil war."
 
Trump senior adviser Stephen Miller reposted the video and observed, “I believe this is called a criminal conspiracy to commit election interference.”

Several non-political figures expressed alarm, such as X-owner and SpaceX CEO Elon Musk who wrote, "That’s a crazy thing for him to say."

However, it is notable that such an attempt by Raskin and House Democrats would likely run afoul of the same difficulties the party encountered during its two attempts to impeach Trump, in that a substantial portion of the Republican caucus would have to agree with them, which presents a likely insurmountable barrier.

Section 3 of the 14th Amendment was voided in its entirety due to acts of 1876 and 1898. No portions remain valid. "Section 3 of the14th Amendment is no longer in effect," Mr. von Spakovsky told The Epoch Times in an email on Sept. 1. He notes that Congress passed two amnesty acts, in 1872 and 1898. Mr. von Spakovsky thoroughly explored the issue in a Heritage paper published last year, stating, "The plain language of these acts permanently removed the insurrection disqualification in Section 3 from the 14th Amendment."
