PEWAUKEE, WI – A 19-year-old out of Waukesha County is facing a charge of battery to an elderly person after allegedly beating an 81-year-old man on the side of the road following a road rage incident which police say stemmed from the victim driving slowly while being tailgated.
On October 28th, authorities say 19-year-old Oliver McSorley and the elderly individual were travelling eastbound on Golf Road in Pewaukee. At some point while both drivers were on the road, authorities say McSorley began to tailgate the elderly driver, with said elder reportedly slowing down in response to the alleged tailgating.
According to officials, the aforementioned road rage antics led to McSorley speeding up and passing the elderly driver, but what could’ve ended in a case of mere bruised egos reportedly culminated into something far more violent in a literal sense. Police say the elderly driver caught up with McSorley at a traffic light near Main Street and College Avenue, allegedly using his vehicle to slightly bump into the rearend of McSorley’s vehicle.
The alleged weaponization of the elderly driver’s vehicle resulted in the two pulling off to the side of the road, with authorities saying the two men began to argue with each other before the elderly man shoved McSorley. In response, McSorley allegedly struck the elderly man several times in the head and body before bystanders intervened and separated the two.
One 911 caller at the scene of the incident reportedly told dispatchers that McSorley was “aggressively punching” the elderly individual while laying in a fetal position on the side of the road, further describing the young defendant’s actions as looking like he was “trying to punch the older man into the ground.”
McSorley reportedly left the scene following the physical altercation but later turned himself in at the Pewaukee Police Department with an attorney present, claiming he acted in self-defense after the elderly individual initiated the physical altercation and allegedly threatened to shoot him. While initially held in custody, McSorley called a relative while at the jail and allegedly said he wished he’d “beaten him to a pulp” and that the elderly victim is “lucky” to have only suffered a concussion.
Although the incident occurred in October, prosecutors didn’t formally file charges until late December. While no official statement has been rendered as to why the charges came as late as they did, it’s possible that the alleged convoluted series of events that led to the physical altercation played a role in how prosecutors thought best to proceed.
