WASHINGTON, DC – This past June, attorney Ivan Raiklin drafted a criminal referral alleging former Metropolitan Police Officer Michael Fanone of “potential violations” of several federal laws, including allegations of giving materially false statements to Congress.
Fanone, the former MPD officer who briefly pivoted to being an on-air analyst at CNN, is being accused in a criminal referral drafted by Raiklin of several violations of federal law in reference to four alleged incidents spanning from July 2021 through January 2026. Of particular note in Raiklin’s drafted referral pertains to Fanone’s sworn testimony delivered before Congress back on July 27th, 2021, stressing that Fanone should be charged with violating 18 U.S.C. § 1001 quickly as the five-year statute of limitations is approaching later in July.
Raiklin, who has dubbed himself the “Secretary of Retribution,” claims Fanone misrepresented and exaggerated testimony delivered to Congress back in July 2021, pointing to when Fanone testified that he “had been beaten, unconscious and remained so for more than four minutes,” as being the alleged falsehood.
“This was presented as resulting from severe physical assault. However, body-worn camera footage and supporting evidence demonstrate that any period of incapacitation was brief and is more accurately described as fainting due to unstable emotional spikes that day caused by internal mental instability, rather than prolonged unconsciousness caused by extended severe physical trauma as portrayed in the sworn testimony,” Raiklin notes in his drafted referral addressed to Acting Attorney General Todd Blanche.
Aside from the alleged false statement claim in Raiklin’s drafted referral, he points to three separate incidents involving direct interactions with Fanone “on or about September 27, 2022; February 23, 2025; and January 22, 2026,” which he alleges provides evidence of assaulting/impeding certain officers or employees, unlawful activity on Capitol grounds, and obstruction of an official proceeding.
The aforementioned incidents involving Fanone were compiled on video shared to social media platform X by Raiklin, who is also reportedly in the process of pursuing civil litigation against Fanone on claims of defamation.
Raiklin closed his drafted criminal referral with, “I am prepared to provide additional evidence, detailed analysis, or sworn testimony to assist in this investigation at any time. This referral is submitted in the interest of accountability and the rule of law. False statements to Congress and the additional violations shown on video cannot be tolerated.”
