NEW YORK, NY - A 31-year-old man, who identifies as a transgender woman, has pleaded guilty to raping a teenage boy in an incident that occurred in early 2025, where the defendant reportedly stalked and sexually assaulted the child in East Harlem. Per the terms of the plea deal, the defendant could walk free with no additional jail time.
As previously reported in Law Enforcement Today, then-30-year-old Nicol Suarez was arrested on February 12, 2025, in connection with a reported sexual assault of a minor that occurred in an East Harlem bodega bathroom the day prior.
Authorities say Suarez, who is a biological male, encountered a 14-year-old boy near Thomas Jefferson Park and followed the victim into the bodega restroom, with the victim later fleeing the establishment after the assault and flagging down nearby bystanders for help.
Suarez was initially charged with first-degree rape and stalking, facing upwards of 32 years in prison if convicted of the aforementioned charges. Yet, a plea deal that was reportedly struck between the Manhattan District Attorney’s Office and the defendant is seeking only 6 months behind bars for second-degree rape.
Despite a second-degree rape conviction in New York carrying a mandatory minimum sentence of 2 years in prison, judges apparently have some discretion in reducing the sentence if provided with mitigating factors related to the criminal offense or defendant.
Since Suarez has been held in pretrial detention since February 2025, if the agreed-upon terms of the outlined plea deal are honored during his sentencing on April 27, he could be subject to release immediately after the 6-month sentence is imposed in light of time served.
According to a spokesperson for the district attorney’s office, the deal with Suarez was reached in order to spare the juvenile victim and his family from having to endure the emotional hardships associated with a trial.
Suarez is also reportedly an illegal alien from Colombia; Immigration and Customs Enforcement (ICE) has an active detainer for the now-convicted child predator. The Manhattan District Attorney’s Office is aware of Suarez’s unlawful status in the country, with the spokesperson for the office claiming they “expect the defendant to remain detained and be deported following sentencing, due to the felony conviction.”
Prior to Suarez’s criminal case out of New York, he had reportedly accrued numerous charges out of Massachusetts after illegally entering the United States back in March of 2023. However, despite being charged with armed robbery, prostitution, and assault with a dangerous weapon in the aforementioned state, Massachusetts’ sanctuary policies allowed him to be released from custody regardless of his immigration status.
